A trademark gains a commercial status after registration, and can be traded, licensed or transferred just like commercial goods.
As in trademark registration, the procedure for the transfer of trademarks are also carried out at the Turkish Patent and Trademark Office.
The transfer is subject to written form by law and the validity of the contract depends only on a formal approve by a notary.
We provide consultancy services for trademark transfer. We examine the transfer from legal and procedural perspectives, file an application in the Office, follow it up and inform you of the outcome.
You can transfer a registered trademark or a trademark that has been filed and is still in progress of registration. The trademark can also be transferred for the whole or part of the goods or services that are registered or applied for.
The trademark transfer process has both a notary and Turkish Patent and Trademark Office phases. An application is filed before the Turkish Patent and Trademark Office after the documents listed are completed. The Office decides on the transfer and logs the trademark into the registry after the trademark transfer is completed.
Trademark License Procedures in Turkey
In principle, a registered trademark is used by the right holder. A license agreement is a legal protocol that enables a trademark owner to partially or fully transfer their rights regarding the use of trademark to any other party.
It is mandatory by law to conclude a trademark license agreement in written form. However, it is not mandatory to do so in a notary public. In principle, parties are free to set terms, content and term of a license agreement.
A trademark right can be the subject of a license agreement for registered goods or services in part or full.
The registration of a license agreement in the Turkish Patent and Trademark Office is of importance to safeguard the rights of parties.
