Trademark Application Opposition Procedure
You can file an opposition against a decision of the Turkish Patent and Trademark Office regarding your application or against applications published in official trademark bulletin on grounds of similarity to your trademark. It is also within the scope of this service to provide feedback on oppositions to your application.
- Opposition against decisions of the Turkish Patent and Trademark Office
The Office may fully or partially reject your application as a result of an examination made after the initial trademark registration application you filed.
An opposition must be filed including paying the necessary fees within 2 months against these decisions given by the Office. If no opposition is made within 2 months, your trademark application will ultimately be rejected.
- Opposition against applications published on Official Trademark Bulletin
After the trademark registration application has been completed, trademarks that comply with all legal requirements are published on Official Trademark Bulletin.
Any similar trademark owners or third parties may file an opposition against these applications.
This is the main service we provide as a part of our trademark monitoring. Official trademark bulletin published twice a month are followed by us in order to protect your registered trademark. Trademark applications that feature similarities with your registered trademark are reported to you. An opposition is filed upon request. As it would be difficult for trademark holders to follow up trademark bulletins and identify similar trademarks, trademark owners are recommended to obtain a trademark monitoring service.
Opposition against the official trademark bulletin is vital for your registered trademark since the publishing period is only two months. Trademark registration is finalized if no opposition is made to the application within this period. Oppositions made after this period are invalid. The only way to be file an appeal against a certain trademark is to file a lawsuit, and this process costs much higher than the opposition procedure.
2.1. Opinion against Opposition before the Office
In case of an opposition made to the trademark published in the official trademark bulletin within two months of publication, the applicant can submit an opinion against the opposition made.
If no opinion or document is submitted against the opposition, the Office examines the opposition in line with the existing information and documents.
There is no obligation to deliver an opinion on an opposition against a trademark application. However, it is crucial to deliver an opinion since those who appeal express their ideas in detail. A counter opinion is sort of a defense against it, and important for protecting your rights.
